Board of Zoning Appeals (BZA)


The Board of Zoning Appeals is composed of five (5) members who are appointed by the Board of Township Trustees and who are residents of the unincorporated territory of the Township included in the area zoned by the Concord Township Zoning Resolution. The terms of all members shall be five (5) years and so arranged that the term of one member will expire each year. Each member of the Board of Zoning Appeals shall serve until his/her successor is appointed and qualified.

The Board of Zoning Appeals shall organize, elect a chairperson and vice-chairperson, and adopt rules in accordance with the provisions of this Zoning Resolution. Meetings of the Board of Zoning Appeals shall be held at the call of the Chairperson and at such other times as the Board of Zoning Appeals may determine. The Chairperson or, in his/her absence, the acting Chairperson may administer oaths, and the Board of Zoning Appeals may compel attendance of witnesses. All meetings of the Board of Zoning Appeals shall be open to the public.

Duties of the Board

The Township Board of Zoning Appeals may:

a) Hear and decide appeals where it is alleged there is error in any order, requirement, decision, or determination made by an administrative official in the enforcement of Section 519.02 to 519.25 of the Ohio Revised Code or of any resolution adopted pursuant thereto.

b) Authorize, upon appeal, in specific cases, such variance from the terms of the Zoning Resolution as will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the Resolution will result in unnecessary hardship, and so that the spirit of the Resolution shall be observed and substantial justice done.

c) Grant conditional zoning certificates for the use of land, buildings, or other structures if such certificates are provided for in the Zoning Resolution.

d) Revoke an authorized conditional use permit for the extraction of minerals if any condition of the certificate is violated.

The Board of Zoning Appeals shall notify the holder of the permit by certified mail of its intent to revoke the permit under division (d) of this section and of his/her right to a hearing before the Board within thirty (30) days of the mailing of the notice, if he/she so requests. If the holder requests a hearing, the Board shall set a time, date and place for the hearing and notify the holder. At the hearing, the holder may appear in person and/or be represented by his/her attorney or other representative, or he/she may present his position in writing. He/she may present evidence and examine witnesses appearing for or against him/her. If no hearing is requested, the Board may revoke the permit without a hearing. The authority to revoke a permit is in addition to any other means of zoning enforcement provided by law.

In exercising the above mentioned powers, such Board may, in conformity with such sections, reverse or affirm, wholly or partly, or may modify the order, requirement, decision, or determination appealed from, and may make such order, requirement, decision, or determination as ought to be made, and to that end has all powers of the officer from whom the appeal is taken.
